The pregnancy continued, and the couple took custody of their son after his birth. Although the disagreement centered on the abortion request, the lawsuit instead alleges the surrogate failed to properly communicate medical information, endangered the pregnancy through negligent behavior, breached confidentiality agreements, and caused severe emotional distress. The surrogate denies all of the claims.
The case has drawn national attention because Canadian law gives pregnant women full authority over their own medical decisions, even in surrogacy arrangements.
While intended parents can express preferences in a surrogacy agreement, they cannot legally require a surrogate to undergo an abortion or any other medical procedure. Experts say disputes of this nature are exceptionally rare and could test the legal boundaries of surrogacy agreements in Canada.
The unnamed surrogate, a single mother, said the lawsuit has been devastating, claiming she was left with thousands of dollars in unpaid pregnancy-related expenses after communication with the couple broke down.
People have been debating the case and the issue ever since it made headlines. One person was concerned about the implications it would have on the child when it was older, writing, “Poor kid will grow up knowing these guys wanted him dead for something he had no control over… it’ll always be in the back of his mind.”
While another added with concern, “They were able to take the baby home with them?!! That baby is in great danger. They should take the child away.”
